Arbitration

Arbitration is a process in which a dispute between two or more parties is resolved in a judicial manner by an arbitrator, whose decision is binding and enforceable at law.


Arbitration seeks to obtain the resolution of disputes impartially without unnecessary delay or expense.


The parties to the arbitration should be fully aware that arbitration is, or should be, extremely flexible with many potential variants of procedure. Arbitration should not be seen as merely a imitation of litigation, but should instead represent to the parties a genuine alternative, where the claimed advantages of time, cost, confidentiality and flexibility are in fact realised.


Fairway has extensive experience of representing both claiming and responding parties in all aspects of the arbitration process.


Fairway’s staff includes arbitrators who are included on the panel of the Chartered Institute of Arbitrators and who are nominated to act as arbitrator.
